By accessing the Site, creating an account, or placing an order, you agree to be bound by these Terms. If you do not agree, please do not use the Site.
1. About Baishare Healthcare
Baishare Healthcare is a personal care brand rooted in Modern Ayurveda and science-backed formulation, offering hair care, skin care, and wellness products to customers in India [and other markets, e.g. UAE].

2. Account Terms
2.1 You may be required to create an account to place an order, track shipments, or access certain features of the Site.
2.2 You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete.
2.3 You are responsible for maintaining the confidentiality of your account login credentials (email/password or OTP-based login) and for all activities that occur under your account.
2.4 You must notify us immediately at baishareindia@gmail.com of any unauthorized use of your account or any other breach of security.
2.5 You must be at least 18 years of age, or the age of legal majority in your jurisdiction, to create an account. Minors may use the Site only under the supervision of a parent or legal guardian who agrees to be bound by these Terms.
2.6 We reserve the right to suspend or terminate accounts that we reasonably believe are being used fraudulently, abusively, or in violation of these Terms.
3. Pricing and Payment
3.1 All prices listed on the Site are in Indian Rupees (INR) and are inclusive of applicable Goods and Services Tax (GST), unless stated otherwise.
3.2 Prices are subject to change without prior notice. However, the price applicable to an order shall be the price displayed at the time the order is placed and payment is confirmed.
3.3 We accept payments via [UPI, Credit/Debit Cards, Net Banking, Wallets, Cash on Delivery (COD), etc. — insert accepted payment methods]. Payments are processed through Shopify Payments and/or third-party payment gateways such as [Razorpay/PayU/insert gateway], and are subject to their respective terms and security protocols.
3.4 We do not store your card or banking credentials on our servers; these are processed securely by our payment gateway partners in compliance with RBI guidelines and PCI-DSS standards.
3.5 In the event of a failed transaction where the amount is debited from your account but the order is not confirmed, the amount will be automatically refunded by the payment gateway/bank within [5–7 business days], or you may contact us at baishareindia@gmail.com for assistance.
3.6 Cash on Delivery (COD), if offered, may be subject to a nominal handling fee and additional verification (such as OTP confirmation) before dispatch.
3.7 We reserve the right to refuse or cancel any order in case of suspected fraudulent payment or pricing errors, with a full refund issued where payment has already been made.
4. Product Descriptions
4.1 We make every effort to display our Products, including ingredients, benefits, usage instructions, and images, as accurately as possible. However, we do not warrant that product descriptions, images, colors, or other content on the Site are completely accurate, current, or error-free.
4.2 Product images are for illustrative purposes; actual packaging, shade, or texture may vary slightly due to factors such as screen display settings, batch variations, or ongoing product improvements.

5. Order Acceptance
5.1 Placing an order on the Site constitutes an offer to purchase the Product(s). All orders are subject to acceptance and availability.
5.2 We reserve the right, at our sole discretion, to refuse or cancel any order for reasons including but not limited to: product unavailability, errors in pricing or product description, suspected fraudulent activity, or failure to comply with these Terms.
5.3 An order confirmation email/SMS sent to you does not constitute our acceptance of your order; it is merely an acknowledgment that we have received your order. A contract of sale is formed only when we dispatch the Product(s) to you and send a shipping confirmation.
5.4 If we cancel an order after payment has been received, we will issue a full refund to your original payment method within [5–7 business days].
5.5 You agree to provide accurate shipping and contact information. We are not responsible for delayed or failed delivery resulting from incorrect information provided by you.
6. Shipping and Delivery

6.4 You will receive a tracking number via email/SMS once your order is dispatched.
6.5 Risk of loss and title for Products pass to you upon our delivery to the courier/shipping partner; however, we will make reasonable efforts to assist in resolving lost or damaged shipments reported within [insert time period, e.g. 48 hours] of expected delivery.

7. Returns and Refunds

- The product is unopened, unused, and in its original sealed packaging.

7.4 Once your return is approved and the product is received and inspected, we will notify you of the approval or rejection of your refund. Approved refunds will be processed to your original payment method within [7–10 business days], or as store credit, at your preference where applicable.
7.5 Shipping charges (if any) are non-refundable, except where the return is due to our error (wrong/damaged/defective product).
7.6 We reserve the right to refuse a return that does not meet the above conditions.

8. Prohibited Uses
You agree not to use the Site for any of the following:
8.1 For any unlawful purpose, or to solicit others to perform or participate in unlawful acts.
8.2 To violate any applicable Indian or international law, statute, ordinance, or regulation, including the Consumer Protection (E-Commerce) Rules, 2020, and the Information Technology Act, 2000.
8.3 To infringe upon or violate our intellectual property rights (including trademarks, logos, product formulations, and content) or the intellectual property rights of others.
8.4 To harass, abuse, insult, harm, defame, slander, disparage, intimidate, or discriminate against any person.
8.5 To submit false or misleading information, place fraudulent orders, or engage in chargeback abuse.
8.6 To upload or transmit viruses, malware, or any code of a destructive nature, or to attempt to gain unauthorized access to the Site, servers, or any systems connected to the Site.
8.7 To scrape, copy, resell, or use our product content, images, descriptions, or pricing for commercial purposes without our prior written consent.
8.8 To use the Site in any manner that could disable, overburden, damage, or impair the Site or interfere with any other party's use of the Site.
We reserve the right to terminate your access to the Site for violating any of the prohibited uses.
9. Limitation of Liability
9.1 To the fullest extent permitted by applicable law, Baishare Healthcare, its directors, employees, affiliates, and partners shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, goodwill, or other intangible losses, arising from:
- your access to or use of, or inability to access or use, the Site or Products;
- any allergic reaction, skin/scalp irritation, or adverse effect resulting from misuse, improper storage, or failure to perform a patch test prior to use;
- any conduct or content of any third party on the Site;
- unauthorized access, use, or alteration of your transmissions or content.
9.2 Our total aggregate liability arising out of or relating to these Terms or your purchase of any Product shall not exceed the amount actually paid by you for the specific order giving rise to the claim.
9.3 Products are intended for external cosmetic use only, as per label instructions. We strongly recommend a patch test before first use and discontinuing use immediately in case of any irritation, followed by consultation with a medical professional.
9.4 Nothing in these Terms shall exclude or limit our liability for death or personal injury caused by proven negligence, fraud, or fraudulent misrepresentation, or any other liability that cannot be excluded or limited under Indian law, including under the Consumer Protection Act, 2019.
10. Governing Law and Jurisdiction
10.1 These Terms and any dispute or claim arising out of or in connection with them (including non-contractual disputes) shall be governed by and construed in accordance with the laws of India.
10.2 Subject to the dispute resolution mechanisms available to you as a consumer under the Consumer Protection Act, 2019 (including approaching the National Consumer Helpline, District/State Consumer Disputes Redressal Commission, or the e-Daakhil portal), any legal action or proceeding arising under these Terms shall be subject to the exclusive jurisdiction of the courts at [Jurisdiction City, e.g. Nagpur, Maharashtra], India.

We aim to acknowledge grievances within 48 hours and resolve them within one month from the date of receipt, in accordance with applicable law.
11. Changes to These Terms
We reserve the right to update or modify these Terms at any time without prior notice. Changes will be effective immediately upon posting to the Site, with the "Last Updated" date revised accordingly. Your continued use of the Site after any changes constitutes acceptance of the revised Terms.
